When A Claim Goes Bad
Frequently Asked QuestionsMedicalLegal LibraryLegislative Corner

Welcome to Policyholders of America (“POA”).

We are a nonprofit association serving policyholders unhappy with their insurers or the insurance industry for reasons ranging from price gouging and credit scoring to claims handling and payment problems.

Look no farther than your own state insurance department and you will find the reason POA’s 3 million members view our organization as a critically necessary public service. Insurance departments rarely intervene in and resolve claims, even when the insurer’s behavior is egregious. Complaints logged with state insurance departments usually end up in the circular file. Why? Because the fox is guarding the hen house. Insurance commissioners usually come out of the insurance industry and immediately upon leaving office, rejoin the industry. These men and women rarely ever want to burn the bridge with their insurance pals, rendering them completely impotent.

POA, on the other hand, advises and arms policyholders with information that gets a legitimate claim paid. We do so at no cost, allowing the policyholder to keep ALL of the money owed them by the insurer. We do not encourage litigation nor do we suggest hiring public adjusters because the policyholder usually walks away with only a fraction of the recovery they deserve under the policy.
POA is not your Grandma’s advocacy organization. Sometimes, our strategies are unorthodox. But, we get results for our members.

POA is financed by membership fees (from full members only) and from small donations from folks who just want to help others. We do not allow into our membership any vendor who might benefit from a policyholder’s claim and accept no money from these benefactors. This may not help our financial statement but it avoids conflicts of interest.

POA does have a free category of membership which many members find is all they need to get their claim paid. Only members (free and full members) will get help from POA.

From a legislative standpoint, insurance companies have run roughshod over their customers. Many legislators seem to have forgotten that the voting public, not the industry, put them in office. POA provides a united and powerful voting block in order that we oust elected officials who have betrayed the policyholder and reward those who have proven their loyalty to policyholders.

POA’s mission at a glance:

Arm policyholders with information that helps get their claims paid;

  • Guide policyholders through the claims process so they receive all benefits under the policy;
  • Lobby to limit the unfair practice of credit scoring and put an end to CLUE reporting, unfair claims delays and denials, premium price gouging, and passing onto policyholders, via rate hikes, insurance-committed bad faith penalties;
  • Challenge elected and appointed officials to establish a more even playing field so that the “Appraisal Process”, a mechanism in most all policies, offers the same consumer protections afforded in arbitration;
  • Expose officials and/or candidates who betray the public’s interest by contorting laws and regulations favoring insurance companies and HMOs who habitually violate insurance statutes; and
  • Endorse officials and/or candidates who are champions for the policyholder, share our vision of fairness and help restore honor to an out-of-control insurance industry.

POA is nonpartisan. We are not afraid to praise and/or bash both sides of the aisle. And we do, although in all fairness, Republicans tend to be love slaves to the insurance industry so we tend to bash far more Republicans than Democrats.

POA is a nonprofit 501c4. We are not affiliated with any lawyer groups, vendors or public adjusters. We exclusively serve the policyholder, no one else.

POA NEWS FLASH

Ralph Nader does a lot of complaining but nas never built a product he liked. POA challenges the typical advocacy philosophies and is in the process of creating several sponsored insurance plans: health, long term care, home, auto and life insurance. We will be launching these plans beginning in 2005 on a state by state basis.

These plans are underwritten by financially sound, consumer-friendly companies who, unlike most in the industry, want to provide great coverage at a fair price, proving that you don’t have to rip-off the consumer to make a fair profit.

Members of POA will not only have access to better coverage at reasonable prices but will have the power of the largest policyholder advocate standing behind the coverage.

To be kept informed about this great member benefit, join POA as a free or full member and click here to sign up for email alerts. . If you are like most, the term "whistleblower" has a negative connotation. The term may remind you of a hall monitor or the class tattletale. Fast forward to adulthood and these courageous people may be the key to insurance reform that ranges from putting an end to price gouging to mandating better claims handling practices. Certainly, our elected and appointed officials have been completely ineffective in curbing fraud. In fact. many would argue that officials have enabled unethical practices by turning a blind eye when they should have enforced the laws.

Click here for our tribute to what may be the policyholder's last hope: insiders who have the courage to step forward even though they do so knowing the personal risks.

Thanks to a State Farm insider turned good guy, POA has been able to secure the much guarded State Farm Claims Manual. This manual is the guide adjusters are SUPPOSED TO USE (but rarely do) to adjust all sorts of claims. We secured it and posted it in our member’s only section. Members can search our documents using all keywords “State Farm Manual” and it will come up as number three of 41 legal documents archived.

Why is the BIGGEST property insurer saying it prefers costly and time consuming litigation over alternate dispute resolution? State Farm slams the door on policyholders who want to go through Appraisal as opposed to hiring lawyers. What does this mean to all State Farm policyholders who OWN this mutual company? Higher rates, of course. CLICK HERE TO READ ABOUT IT

Need PROOF of weather conditions for a claim?

Is your insurance company claiming that your roof was not damaged by hail? Or, that it wasn’t raining when the guy behind you, slammed into your car because of slippery conditions? How about when the insurance company says lightning didn’t blow out all of your appliances and computer?

Compu-Weather's unique forensic weather services can scan each and every past weather record to carefully focus on past weather at your point-of-loss, not an airport ten miles away. They do this by carefully analyzing detailed weather records, radar, satellite, and past weather reports that are archived daily. For more information, go to: http://www.compuweather.com

CALIFORNIA WILDFIRE VICTIMS

On November 15th, Policyholders of America sponsored free workshops for wildfire survivors embroiled in battles with their insurers.

Not everything is as rosy as the insurance industry would like for everyone to believe. Among the most common complaints: under-insurance penalties being applied to those who listened to their agent/insurer as to replacement values and policy limits, lowballing repairs and replacement costs, forcing the insurance company's sweetheart yet unqualified contractors onto homeowners, not applying all coverage, denying coverage, applying excessive depreciation and cheating homeowners out of additional living expenses.

Policyholders of America put together a prestigious panel of coverage and construction experts to address the concerns of area homeowners so these victims can get their lives back.

Big campaign promises of rate relief and insurance reform led many to believe such reforms were right around the corner. Not so. Obviously, many policyholders won't see any relief during their lifetimes.

At a recent Department of Insurance public hearing, this member plopped himself down in the front row to question regulators about their promise of rate relief.

GET A CLUE

CLUE is a national database that tracks types of homeowners' claims filed. When you apply for home insurance, your insurer will request a CLUE report to determine whether you, the buyer, or the home seller have filed any claims during the past five years.

You can get a free copy of your CLUE report if you are denied insurance due to information contained in your CLUE report. If you have a dispute with an insurer about the one-sided information in the report, you can ask that your account of the events be included in the report. If you are simply curious about your home's history, you can order a copy from the company that owns the CLUE database (ChoicePoint).

Here's how to order:

You can order a copy of your CLUE report for under $13.00 by calling (866) 527-2600. This fall ChoicePoint will make it possible for you to access your CLUE report via the Internet at its Web site, click here.
